1. Acceptance of Terms

By accessing or using the Amphomite email client and related services provided by Amphomite Inc. ("Amphomite," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Amphomite is an email client application that connects to your existing email provider accounts (e.g., Gmail, Outlook, IMAP) to provide enhanced email management features including AI-assisted triage, keyboard-driven workflows, and unified inbox management.

3. User Accounts

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized access to your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, unsolicited messages, or bulk communications
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the integrity or performance of the Service
• Reverse-engineer, decompile, or disassemble any part of the Service

5. Subscription and Billing

Free accounts are available with limited features. Paid plans (Pro, Team) are billed monthly or annually as selected during subscription. Prices are subject to change with 30 days' notice. All paid plans include a 14-day free trial.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We offer a 30-day money-back guarantee for first-time subscribers.

6. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Amphomite Inc. and its licensors. The Service is protected by copyright, trademark, and other laws.

7. Limitation of Liability

To the maximum extent permitted by law, Amphomite Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Termination

We reserve the right to terminate or suspend your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of San Francisco County, California.
